Terms for Our Swimming Lessons
We are confident in what we deliver and we hope that you enjoy your time with us! However, you know what suits you best so if you decide after your first lesson – but before your first payment is taken or your scheduled second lesson (whichever comes first) – that you no longer wish to continue your swimming lessons with ‘Dolphin Academy’, we will cancel your booking and your subscription.
‘Dolphin Academy’ cannot guarantee the same teacher for every session but will try our best to keep consistency. All our instructors are ASA or STA qualified teachers, lifeguard trained, have enhanced DBS disclosures and are fully insured. Refusal to accept a lesson from a replacement teacher will result in that lesson being forfeited.
During their time with ‘Dolphin Academy’, the day and time of a swimmer’s session is subject to change as the swimmer progresses through the scheme. You will be contacted and given a selection of days and times available to enrol your child onto the next stage when necessary.
All lesson fees must be made and up to date prior to a swimmer’s lesson. Swimmers will not be allowed to participate in any swimming lesson until a monthly subscription has been paid for or set up on Class4Kids.
As subscriptions are taken on the first of every month in advance of lessons, new customers who begin lessons before making their first payment may be subject to a Covering Payment. This will be prorated and added to your first payment. The following month will revert to the normal price.
Existing customers may be subject to a Covering Payment or Subscription Price Change if they change or add lessons outside of their original plan.
In all instances of a Covering Payment or a Subscription Price Change, customers will be informed by email.
Lesson fees paid to ‘Dolphin Academy’ only permit the swimmer to take part in a lesson. Fees do not permit a parent, guardian or sibling to swim in ‘DW Sports Fitness’ pool or otherwise.
Re-enrolment for the next block of lessons is completed automatically by a subscription payment made through Class4Kids on the 1st of every month. This monthly payment will continue until you give 30 days written notice via email to [email protected] If the payment fails on the 1st, there will be a reattempt to take this payment 3 days later (4th). If this second attempt fails, a final attempt will be made 5 days later (9th). Swimmers may however be refused entry during this period until payments are brought up to date.
It is the customer’s responsibility to maintain payments for the swimmer’s lessons as their place may be forfeited and offered to someone else on the waiting list if payments are not up to date.
Adverse Weather Conditions
Unfortunately, in this country, we are often on the receiving end of some really bad weather. Heavy rain, gale force winds, snow, ice, etc.! This can sometimes result in a pool being closed because the operator’s staff can’t get to work. If this happens, we will let you know with as much notice as possible. A catch-up lesson will be offered when the pool reopens. But if the pool is open, our lessons will go ahead as normal.
Any lessons not attended by a swimmer are forfeited, whether due to illness or holidays.
The safety and progression of your child’s swimming is of paramount important to us so we want to keep disruption to a minimum. Therefore, if a child is more than 10 minutes late for their lesson, or takes more than 5 minutes to get in the water, they will be refused entry and their lesson forfeited without compensation.
If a lesson is cancelled for unforeseen reasons by ‘Dolphin Academy’, a message will be sent at our earliest opportunity via text to the mobile phone number supplied to us by you. It is the customer’s responsibility to keep ‘Dolphin Academy’ updated of any changes to the details submitted to us on your initial booking. Any cancelled lessons by us, will be rearranged as a catch-up lesson.
In accordance with our ‘Satisfaction Guarantee’, if you decide after your first lesson – but before your scheduled second lesson – that you no longer wish to continue your swimming lessons with ‘Dolphin Academy’, we will return 100% of your initial enrolment fees to you.
Other than the ‘Satisfaction Guarantee’, lessons cannot be cancelled once a payment has been made. If a swimmer does not wish to continue their lessons, or wishes to amend the day or time of their lessons, please give 30 days’ written notice via email to [email protected] Lessons cannot to transferred, offered as credit or be refunded once a payment has been made.
Any lessons not attended by a swimmer are forfeited, whether due to illness or holidays.
All swimmers are notified of term dates upon booking. Swimmers will also be notified via social media of any holiday closures that will affect lessons, such as at Christmas and Bank Holidays. During these periods, the monthly subscription price will not be changed. If a customer does not wish to enrol for that month, please send a cancellation email as per our ‘Re-enrolement’ provision above. Cancellation cannot be completed retrospectively and, as such, we will not offer refunds, or partial refunds for lessons which fall on these dates.
Medical/Behavioural Conditions and Individual Needs
It is important to us that we provide the best lesson for each swimmer with us however, ‘Dolphin Academy’ cannot accept responsibility for the medical/behavioural condition or other needs of any swimmer unless a full disclosure of the details has been made through your initial booking prior to commencement of lessons or following any medical/behavioural condition being confirmed during a term of lessons. It is the customer’s responsibility to keep ‘Dolphin Academy’ updated of any changes to the details submitted to us on your initial booking.
Swimmers, parents, guardians, siblings and all other associates must observe the venue’s entry rules and respect all other venue rules whilst within the facilities. Club staff shall retain the right to refuse admission. It is imperative that swimmers are on poolside NO MORE than 5 minutes before the commencement of each lesson and must be collected promptly after the lesson has ended. Children must not be left unsupervised on poolside prior to the start of their class and a responsible adult must remain within the facility during the whole of the lesson.
Parents/guardians and those wishing to view lessons are not permitted to remain on poolside during the lesson. Instead we will offer designated viewing areas away from poolside for the safety and security of viewers and for the children themselves.
In the event of a swimmer, parent, guardian, sibling or other associate refusing to obey an instruction from a member of staff, behaving in an unruly manner towards a member of staff or any other person, or causing damage to pool premises or equipment in those premises, the swimmer shall not be permitted to continue with the lessons. ‘Dolphin Academy’ reserves the right to terminate the lessons without further notice and without being required to offer any credit or refund to the swimmer. The swimmer shall not be accepted for any future courses also.
The staff reserve the right to enforce their own centre rules with regard to behaviour. Any swimmer, parent, guardian, sibling or other associate behaving in a manner that the centre feel inappropriate or detrimental to other members will be informed as such and may be therefore asked to leave the premises. Any such behaviour may result in ‘Dolphin Academy’ reserving the right to terminate the lessons without further notice and without being required to offer any credit or refund to the swimmer. The swimmer shall not be accepted for any future courses also.
Parents/guardians taking photos in a lesson is strictly prohibited. Any customer seen to be taking photographs/videos during a lesson may be asked to leave and will not be permitted to continue with their Dolphin Academy journey. Dolphin Academy reserves the right to terminate the lessons without further notice and without being required to offer any credit or refund to the swimmer. The swimmer shall not be accepted for any future courses also.
‘Dolphin Academy’ cannot accept liability for the loss of, or damage to, any personal effects brought to any session and you are therefore requested to ensure that no valuable items are brought to swimming lessons.
Condition of Pool Premises
Whilst ‘Dolphin Academy’ will make all reasonable efforts to ensure that the condition of the pool premises, including the changing rooms, washing facilities, the pool and poolside area are in suitable condition, they do not accept liability for any injury to a swimmer which may be caused by any defect and further advise that any claim arising from such a defect must be addressed to the proprietors of the pool premises.
Transmission of Infections
Any swimmer known to be or found to be suffering from any infectious ailment or condition will not be allowed to participate in the lesson and it is the responsibility of each swimmer or (in the case of a child swimmer) the parent or guardian of the swimmer to ensure that the swimmer is fit and well enough to participate. ‘Dolphin Academy’ reserves the right to refuse entry, or ask a swimmer to leave mid lesson, if they reasonably believe the swimmer to be ill. These lessons will be forfeited without compensation. ‘Dolphin Academy’ will not accept liability for any infection passed to a swimmer by another swimmer.
Dolphin Academy and the pool owners cannot accept any responsibility for any incident that was the sole responsibility of the swimming teacher in charge of the class or lesson in which the incident occurred. Full liability, in such cases, is with the teacher delivering the lesson.

Additional Terms for Mermaid Swimming
The participants, who are attending any MermaidsUK Swim Course or Experience, must be aware that Dolphin Academy is not liable for any accidents, injuries or claims caused by the actions of any participant within the classes. It is the parent/carers responsibility to maintain their child’s safety both prior to and after the lesson. Dolphin Academy have the right to remove or refuse a participant without a refund if they are disrespectful towards other participants/instructors, show blatant disregard to directions or show signs of being a threat to the safety of themselves or other participants within the lesson.
All participants will be required to fill out additional enrolment forms and disclaimers and must be returned 72 hours prior to their mermaid swimming lesson/experience. Failure to do so, or provide false information, will result in the participant being refused entry without a refund.
Mermaid Swimming is not included in our ‘Satisfaction Guarantee’ as it relates specifically to our Learn to Swim Programme. Once a payment has been made, a refund will not be issued for our Mermaid Lessons, Experiences, or Parties if a parent/guardian wishes to cancel.
Mermaid Swimming Lessons Requirements
All participants must:
- Be at least 6 years old
- Be able to swim 25 meters comfortably
- Be able to submerge your face fully whilst swimming
- Be able to tread water in both shallow and deep water
- Be able to life your knees and turn 360 degrees in both directions
- Be able to demonstrate a basic dolphin kick for 5 meters
In the event of a swim test fail based on the criteria above, any monies paid will be issued as a credit note for Dolphin Academy services’ minus a £15 administration fee. The participant will not be able to continue with the rest of the block for their safety.
